General terms and conditions of sale
1. Scope of application
These general terms and conditions of sale (GTCS) apply to all orders placed by our customers via the online shop of CriolloQuetzal Ltd., Rue des Cerisiers 10, 1530 Payerne, tel: 077 267 21 38, e-mail: choco(at)criolloquetzal.com, identification number: CHE-210.403.174 (hereinafter referred to as the CriolloQuetzal online shop).
2. Offer and Conclusion of Contract
2.1
Presentation of the products on the online shop does not constitute contractual obligation, but only an invitation to place an order.
2.2
By clicking on the [order] button, the Customer places a binding order for the products displayed in the shopping basket. Once the order has been sent, the customer is no longer able to change it.
2.3
Upon receiving the order, the CriolloQuetzal online shop sends an acknowledgement of receipt to the customer by e-mail.
The contract is concluded once the CriolloQuetzal Online Shop confirms dispatch of the goods by e-mail, or, at the latest, at the time of delivery of the goods.
3. Products containing Alcohol
The sale of products containing alcohol to persons under 18 years of age is prohibited in Switzerland.
By placing an order on the CriolloQuetzal online shop, the customer acknowledges these regulations and confirms that he/she is authorised to proceed with the purchase.
4. Prices
4.1
The prices of products shown on the corresponding pages include the applicable VAT and other price components and are in Swiss francs (CHF).
4.2
The applicable prices are those displayed on the day the customer places the order. Prices are firm and final until confirmation of the order by the CriolloQuetzal online shop or for the duration mentioned on the order confirmation.
4.3
Prices are subject to change due to changes in taxation, fees, taxes or shipping costs.
5. Shipping costs
The shipment of all orders is at the customer’s expense. Shipping costs include a contribution towards postage and packaging costs. Any import customs duties are not included and are entirely borne by the client.
In Switzerland: Flat rate shipping costs of CHF 5.-
In Europe: Variable shipping costs according to weight (2kg maximin per order), displayed constantly on the Shopping cart page before payment of the order.
6. Terms and Conditions of Delivery
6.1
Deliveries made in Switzerland and the following countries: Germany, Austria, Belgium, Cyprus Croatia, Denmark, Spain, Estonia, Finland, France Great Britain, Greece, Hungary, Ilse of Mann, Ireland, Iceland, Italy, Jersey, Latvia, Lithuania, Luxembourg, Malta, Norway, Holland, Poland, Portugal, Czech Republic, Romania, Serbia, Slovakia, Slovenia, Sweden.
In Switzerland: Parcels sent via Economy with tracking
In Europe: Parcels sent via Priority with tracking
6.2
The CriolloQuetzal online shop cannot be held responsible for delivery delays beyond its control, e.g. in cases of force majeure, traffic, bad weather conditions, etc. Likewise, in these cases, the customer can neither assert their right of withdrawal nor claim damages.
6.3
In case of unavailability of certain ordered products, the CriolloQuetzal online shop is entitled to make partial deliveries.
6.4
If delivery of the goods fails through the customer’s fault despite three delivery attempts, the CriolloQuetzal Online-Shop is entitled to terminate the contract. In that case, the customer is not entitled to a refund.
7. Terms of Payment
7.1
Payment shall be made in advance.
7.2
Payment is made either by Twint, Paypal or by credit card (American Express, Visa or Mastercard).
7.3
In all cases, payments are debited immediately.
7.4
Under no circumstances can a customer use a sum they are owed by Criollo Quetzal to pay or partly pay for a new purchase.
7.5

8. Shipping
8.1
Deliveries made in Switzerland and the following countries: Germany, Austria, Belgium, Cyprus Croatia, Denmark, Spain, Estonia, Finland, France Great Britain, Greece, Hungary, Ilse of Mann, Ireland, Iceland, Italy, Jersey, Latvia, Lithuania, Luxembourg, Malta, Norway, Holland, Poland, Portugal, Czech Republic, Romania, Serbia, Slovakia, Slovenia, Sweden.
The shipment is done by Swiss Post.
Deliveries in Switzerland take about 2 days. In Europe they take between 3-10 days.
8.2
Orders placed on Saturdays, Sundays or public holidays are normally shipped on the following working day.
We recommend you order in good time. Orders made before a public holiday will result in longer waiting times.
8.3
To ensure that your order reaches you in good condition during the summer months or in hot weather, we may take the liberty of holding it for a certain period of time (in which case you will be automatically informed by e-mail with the new expected delivery date).
8.4
Shipping costs include a contribution to postage and packaging costs.
9. Retention of title
The CriolloQuetzal online shop retains ownership of the goods until full payment of the purchase price and until they are dispatched.
10. Right of Withdrawal
10.1
The consumer is entitled to exercise his/her right of withdrawal within 14 days of receipt of the goods. The date that the notice of withdrawal is sent shall be considered the date of withdrawal. Justification for the withdrawal is not necessary. The notice of withdrawal must be sent to: CriolloQuetzal Sàrl, Rue des Cerisiers 10, 1530 Payerne. Or by e-mail to choco(at)criolloquetzal.com.
10.2
Exercise of the right of withdrawal shall result in the termination of the sales contract. Accordingly, the goods received within the framework of the sales contract are to be returned.
The consumer must return the goods with their original packaging to the CriolloQuetzal online shop within 14 days of the date of withdrawal. The shipping costs for the return of the goods are at the expense of the customer.
10.3
After receipt of the goods by the CriolloQuetzal online shop, the purchase price will be refunded to the consumer, subject to a possible deduction in case of damaged or missing goods.
If it is necessary to damage the goods in order to determine their nature and quality, no deduction will be made for the loss of value thus caused.
10.4
The right of withdrawal is excluded for the following products:
- Goods that are perishable at short notice
- Goods whose use-by date has passed
11. Guarantee
11.1
The guarantee services provided by the CriolloQuetzal online shop relate to the removal of defects. To this end, the CriolloQuetzal Online Shop delivers faultless goods (replacement delivery).
11.2
If the replacement delivery fails, the customer is entitled to withdraw from the contract. This does not apply to minor defects. The customer's right to a price reduction is excluded.
11.3
The recipient undertakes to check the quantities and condition of the goods immediately upon receipt of the delivery. Complaints regarding quality or quantity must be reported immediately to the CriolloQuetzal online shop or within 24 hours after delivery. Otherwise, the delivery will be considered as accepted.
11.4
The CriolloQuetzal webshop cannot be held responsible for damage during transport or for damage caused by improper storage of the goods after they have been taken over by the customer or one of their auxiliaries.
11.5
In case of defects, the goods are to be returned to CriolloQuetzal Sàrl, Rue des Cerisiers 10, 1530 Payerne. Return of the goods is at the expense and risk of the CriolloQuetzal online shop.
Obligations to reimburse are fulfilled within 30 days of receipt of the goods. The CriolloQuetzal online shop is entitled to deduct any replacement deliveries from the purchase price. In case of return of elements of a set, the price reduction granted by the CriolloQuetzal online shop on all elements of the set is no longer valid. For this reason, the customer will only receive a refund for the returned items in the amount of the difference between the price of the complete set and the price of the items that he/she keeps. In order to facilitate processing of the returned goods, we recommend returning them in their original packaging, enclosing the invoice or delivery note and using secure packaging.
12. Liability
The CriolloQuetzal online shop accepts no liability for slightly negligent breaches of contractual obligations. The same applies to breaches of contractual obligations caused by auxiliaries or replacements.
13. Applicable law
13.1
Contracts are governed exclusively by Swiss law.
13.2
The exclusive place of jurisdiction is Payerne, Vaud, subject to appeal to the Swiss Federal Court. In the event of misinterpretation, only the French version shall be authoritative.
14. Final Provisions
Should one of the clauses of these general terms and conditions of sale prove to be null and void, this shall not affect the validity of the other clauses. The invalid provisions will then be replaced by the corresponding legal provisions.
