General terms and conditions of sale

1. Scope of application

These general terms and conditions of sale (GTCS) apply to all orders placed by our customers via the online shop of CriolloQuetzal Ltd., Rue des Cerisiers 10, 1530 Payerne, tel: 077 267 21 38, e-mail: choco(at)criolloquetzal.com, identification number: CHE-210.403.174 (hereinafter referred to as the CriolloQuetzal online shop).

2. Offer and Conclusion of Contract

2.1

Presentation of the products on the online shop does not constitute contractual obligation, but only an invitation to place an order.

2.2

By clicking on the [order] button, the Customer places a binding order for the products displayed in the shopping basket. Once the order has been sent, the customer is no longer able to change it.

2.3

Upon receiving the order, the CriolloQuetzal online shop sends an acknowledgement of receipt to the customer by e-mail.

The contract is concluded once the CriolloQuetzal Online Shop confirms dispatch of the goods by e-mail, or, at the latest, at the time of delivery of the goods.

3. Products containing Alcohol

The sale of products containing alcohol to persons under 18 years of age is prohibited in Switzerland.

By placing an order on the CriolloQuetzal online shop, the customer acknowledges these regulations and confirms that he/she is authorised to proceed with the purchase.

4. Prices

4.1

The prices of products shown on the corresponding pages include the applicable VAT and other price components and are in Swiss francs (CHF).

4.2

The applicable prices are those displayed on the day the customer places the order. Prices are firm and final until confirmation of the order by the CriolloQuetzal online shop or for the duration mentioned on the order confirmation.

4.3

Prices are subject to change due to changes in taxation, fees, taxes or shipping costs.

5. Shipping costs

The shipment of all orders is at the customer’s expense. Shipping costs include a contribution towards postage and packaging costs.

Any customs duties on imports (purchases by customers outside Switzerland) are not included and are entirely at the customer's expense.

In Switzerland: Flat rate shipping costs of CHF 5.- (Economy shipping) or CHF 8.- (Priority shipping).
International: Variable shipping costs according to weight.

6. Terms and Conditions of Delivery

6.1

Deliveries made in Switzerland and the following countries: Germany, Austria, Belgium, Cyprus Croatia, Denmark, Spain, Estonia, Finland, France Great Britain, Greece, Hungary, Ilse of Mann, Ireland, Iceland, Italy, Jersey, Latvia, Lithuania, Luxembourg, Malta, Norway, Holland, Poland, Portugal, Czech Republic, Romania, Serbia, Slovakia, Slovenia, Sweden.

In Switzerland : Economy or Priority shipment by Swiss Post with tracking number
International: Shipped by Swiss Post (Switzerland); then, Priority Plus shipment by national postal service (destination country) with tracking number.

6.2

The CriolloQuetzal online shop cannot be held responsible for delivery delays beyond its control, e.g. in cases of force majeure, traffic, bad weather conditions, etc. Likewise, in these cases, the customer can neither assert their right of withdrawal nor claim damages.

6.3

In case of unavailability of certain ordered products, the CriolloQuetzal online shop is entitled to make partial deliveries.

6.4

If, despite three delivery attempts, delivery was not completed on the customer’s part or if the parcel is not collected at the customer's post office, the CriolloQuetzal Online-Shop is entitled to terminate the contract. In that case, the customer is not entitled to a refund.

7. Terms of Payment

7.1

Payment shall be made in advance.

7.2

Accepted payment methods are Paypal, Apple Pay, Google Pay and credit cards (American Express, Visa, Mastercard, Diners Club or JCB). Swiss customers may also pay with Twint, Postfinance Card or Postfinance E-Finance.

7.3

In all cases, payments are debited immediately.

7.4

Under no circumstances can a customer use a sum they are owed by Criollo Quetzal to pay or partly pay for a new purchase.

7.5

8. Shipping

8.1

Delivery in Switzerland takes between 2 days (Priority) and 4 days (Economy) and is handled by Swiss Post.
International delivery usually takes 3-10 days and is carried out by the national postal service.

8.2

Orders placed on Saturdays, Sundays or public holidays are normally shipped on the following working day.

We recommend you order in good time. Orders made before a public holiday will result in longer waiting times.

8.3

To ensure that your order reaches you in good condition during the summer months or in hot weather, we may take the liberty of holding it for a certain period of time (in which case you will be automatically informed by e-mail with the new expected delivery date).

8.4

Shipping costs include a contribution to postage and packaging costs.

8.5

By selecting the free "Gift wrapping" option at checkout, all products in the shopping cart will be wrapped together (quantity and size permitting), or in several packs for larger quantities or important format differences, in colored tissue paper, with at least one company card featuring the store concept.

9. Retention of title

The CriolloQuetzal online shop retains ownership of the goods until full payment of the purchase price and until they are dispatched.

10. Right of Withdrawal

10.1

The consumer is entitled to exercise his/her right of withdrawal within 14 days of receipt of the goods. The date that the notice of withdrawal is sent shall be considered the date of withdrawal. Justification for the withdrawal is not necessary. The notice of withdrawal must be sent to: CriolloQuetzal Sàrl, Rue des Cerisiers 10, 1530 Payerne. Or by e-mail to choco(at)criolloquetzal.com.

10.2

Exercise of the right of withdrawal shall result in the termination of the sales contract. Accordingly, the goods received within the framework of the sales contract are to be returned.

The consumer must return the goods with their original packaging to the CriolloQuetzal online shop within 14 days of the date of withdrawal. The shipping costs for the return of the goods are at the expense of the customer.

10.3

After receipt of the goods by the CriolloQuetzal online shop, the purchase price will be refunded to the consumer, subject to a possible deduction in case of damaged or missing goods.

If it is necessary to damage the goods in order to determine their nature and quality, no deduction will be made for the loss of value thus caused.

10.4

The right of withdrawal is excluded for the following products:

- Products with a short shelf-life (use-by date of 0-2 months)

- Goods whose use-by date has passed

11. Minimum consumption period and exceptions

11.1

Products offered for sale by the CriolloQuetzal online store have a minimum use-by-date of 2 months and must therefore be consumed within the same period.

11.2

In an ongoing effort to limit food waste, certain products are offered at a discount of 25% or 50% off the original price, according to the following principle:

25% discount = Product with use-by date of 31-60 days

50% discount = Product with use-by date of less than one month

By purchasing one of these products, the customer accepts a reduced use-by date compared to the same product sold at the usual price.

12. Guarantee

12.1

The guarantee services provided by the CriolloQuetzal online shop relate to the removal of defects. To this end, the CriolloQuetzal Online Shop delivers faultless goods (replacement delivery).

12.2

If the replacement delivery fails, the customer is entitled to withdraw from the contract. This does not apply to minor defects. The customer's right to a price reduction is excluded.

12.3

The recipient undertakes to check the quantities and condition of the goods immediately upon receipt of the delivery. Complaints regarding quality or quantity must be reported immediately to the CriolloQuetzal online shop or within 24 hours after delivery. Otherwise, the delivery will be considered as accepted.

12.4

The CriolloQuetzal webshop cannot be held responsible for damage during transport or for damage caused by improper storage of the goods after they have been taken over by the customer or one of their auxiliaries.

12.5

In case of defects, the goods are to be returned to CriolloQuetzal Sàrl, Rue des Cerisiers 10, 1530 Payerne. Return of the goods is at the expense and risk of the CriolloQuetzal online shop.

Obligations to reimburse are fulfilled within 30 days of receipt of the goods. The CriolloQuetzal online shop is entitled to deduct any replacement deliveries from the purchase price. In case of return of elements of a set, the price reduction granted by the CriolloQuetzal online shop on all elements of the set is no longer valid. For this reason, the customer will only receive a refund for the returned items in the amount of the difference between the price of the complete set and the price of the items that he/she keeps. In order to facilitate processing of the returned goods, we recommend returning them in their original packaging, enclosing the invoice or delivery note and using secure packaging.

13. Liability

The CriolloQuetzal online shop accepts no liability for slightly negligent breaches of contractual obligations. The same applies to breaches of contractual obligations caused by auxiliaries or replacements.

14. Applicable law

14.1

Contracts are governed exclusively by Swiss law.

14.2

The exclusive place of jurisdiction is Payerne, Vaud, subject to appeal to the Swiss Federal Court. In the event of misinterpretation, only the French version shall be authoritative.

15. Final Provisions

Should one of the clauses of these general terms and conditions of sale prove to be null and void, this shall not affect the validity of the other clauses. The invalid provisions will then be replaced by the corresponding legal provisions.
